§ 1 Scope, Order of Precedence and Contract Language
1.1 These Technical Terms of Delivery and Manufacturing (hereinafter “TLB”) specify the technical, manufacturing and inspection-related requirements applicable to the products and services of Bock Maschinenbau GmbH (hereinafter “Bock”). They apply in addition to Bock’s General Terms and Conditions of Sale, Delivery and Payment (GTC).
1.2 The TLB apply exclusively vis-à-vis entrepreneurs within the meaning of § 14 BGB (German Civil Code), legal persons under public law and special funds under public law.
1.3 Order of precedence of contract documents: The order of precedence in the event of conflicts between contractual documents is governed exclusively by the provision of the GTC (§ 2.4). Therein, the TLB rank after the customer’s order and before the GTC. There is thus only one authoritative order of precedence.
1.4 Governing language: Only the German-language version of these TLB is legally binding. Translations serve solely for comprehension; in the event of discrepancies, the German version shall prevail exclusively.
1.5 Standard versions and certificates: Insofar as these TLB refer to technical standards or codes, the version valid at the time of conclusion of the contract shall apply, unless a specific edition has been expressly agreed or the respectively valid scope of a certificate is authoritative. References to certifications of Bock always relate to the respectively valid certificate.
§ 2 Contract Documents, Drawings and Data
2.1 Authoritative for manufacturing is the drawing and data status released at the time of conclusion of the contract, with an unambiguous revision status. Subsequent changes require text form and an amended order confirmation.
2.2 If the customer provides drawings, models, CAD data, specifications or samples, the customer is responsible for their correctness, completeness and freedom from third-party intellectual property rights. Bock does not check provided documents for design or computational correctness unless such a check has been expressly agreed as a service.
2.3 Precedence of documents: Individually dimensioned and toleranced features of the released 2D drawing take precedence. For geometries not fully defined therein, the released 3D model is authoritative, unless expressly agreed otherwise. The unit of measurement, drawing or model revision, and any precedence of PMI/MBD data must be stated in the documents. Customary exchange formats are common neutral 3D formats (e.g. STEP) as well as dimensioned 2D drawings (e.g. PDF); deviating formats subject to agreement.
2.4 Bock shall notify the customer of recognizable inconsistencies, contradictions or errors in provided documents; in all other respects, the duty to give notice pursuant to GTC § 8.5 applies.
2.5 Changes: Subsequent changes to drawings, models, quantities, materials, inspection or documentation requirements may lead to adjustments of the remuneration and the delivery date. Expenses already incurred, materials procured, work commenced and parts that can no longer be used as a result of the change shall be remunerated by the customer at the agreed prices, or in the alternative according to actual expenditure at Bock’s customary rates, insofar as Bock is not responsible for the change.
§ 3 Materials, Traceability and Re-stamping
3.1 The material to be used, including grade, delivery condition and, where applicable, additional requirements (e.g. requirements for the properties in the through-thickness direction, Z-grade), must be specified by the customer or in the contract documents. If material specifications essential for the contractual use are missing, Bock is entitled to defer execution until clarification. Only for parts expressly agreed as simple standard or auxiliary parts does Bock select a commercially available material of commercially available quality.
3.2 Material certificates pursuant to DIN EN 10204 are only prepared or furnished if expressly ordered (see § 8 of these TLB as well as GTC § 8.7).
3.3 Re-stamping: Bock is entitled to transfer material markings onto separated or machined material parts within the scope of its respectively valid re-stamping authorization (re-stamping) and to document the transfer. The authorization covers the transfer of the marking of metallic materials with inspection certificate 3.1 pursuant to DIN EN 10204; the documented reference to the original certificate is retained.
3.4 A batch or heat allocation is carried out insofar as this is required for the ordered certificate scope.
§ 4 General Tolerances
4.1 The dimensional, form and positional tolerances specified in the released drawing always take precedence.
4.2 In the absence of a tolerance specification, the following general tolerance standards apply, in the version respectively valid at the time of conclusion of the contract:
- Machined individual parts as well as machined features on welded structures – linear and angular dimensions: DIN ISO 2768-1, tolerance class m.
- Non-machined dimensions, forms and positions of welded structures: DIN EN ISO 13920 – dimensional tolerances class B, form and positional tolerances class F.
- Thermally cut edges (flame, plasma, laser cutting): DIN EN ISO 9013; the authoritative tolerance or quality class results from the drawing or a separate agreement.
4.3 Form and positional tolerances of machined features that are not covered by the foregoing standards must be specified in the drawing. Without such specification, Bock in this respect owes no stricter requirements than the generally recognized rules of technology; in case of doubt, consultation must be held before the start of manufacturing. Dimensional deviations within the tolerances authoritative under § 4.2 do not constitute a defect.
4.4 If no tolerance or quality class pursuant to DIN EN ISO 9013 is agreed for thermally cut edges or derivable from the drawing, no particular class is owed without an express agreement; Bock is entitled to defer execution until clarification.
§ 5 Welding
5.1 As a welding operation, Bock is certified for the execution of load-bearing steel components pursuant to DIN EN 1090-2 (execution class EXC3; certification body DVS ZERT) and fulfils the comprehensive quality requirements for the fusion welding of metallic materials pursuant to DIN EN ISO 3834-2. The scope and validity of the certificates can be viewed under “Company › Certifications”.
5.2 Within the scope of the certifications referred to in § 5.1, the welding processes 121 (submerged arc welding) and 135 (metal active gas welding) as well as the material groups 1.1 and 1.2 (non-alloy and low-alloy steels), 3.1 (quenched and tempered fine-grain steels) and 8.1 (austenitic stainless steels) are covered. The scope of the respectively valid certificate remains authoritative.
5.3 Work is carried out on the basis of valid welding procedure specifications (WPS) pursuant to DIN EN ISO 15609-1, whose welding procedures, where required, are qualified by procedure tests or welding procedure qualification records (WPQR) pursuant to the respectively applicable qualification standards, in particular DIN EN ISO 15614-1. Validly qualified welders are deployed, as well as – depending on the degree of mechanization, in particular in submerged arc welding – qualified welding operators or setters. Welding supervision is performed by qualified personnel (International Welding Engineer IWE, International Welding Technologist IWS).
5.4 The execution class (EXC) authoritative for the order, the weld seam quality, the scope of inspection and the respective acceptance criteria must be specified by the customer or the responsible designer in the contract documents (execution specification). Bock performs the work exclusively within the scope of its respectively valid certifications. If required specifications are missing, Bock is entitled to defer execution until clarification.
§ 6 Surface, Edges and Corrosion Protection
6.1 Without a special agreement, parts are delivered in the surface condition resulting from manufacturing. Manufacturing-related characteristics such as mill scale, oxide scale, machining marks and heat tint at weld seams are permissible, insofar as they do not impair the agreed function, corrosion resistance, coatability or further processing.
6.2 Minor residual burrs that remain due to manufacturing and are harmless for handling, assembly and contractual use are permissible. A defined edge machining, edge rounding or complete deburring is only owed if it is agreed or specified in the drawing.
6.3 Corrosion protection (blasting, priming, coating, galvanizing and the like) is not standard and is carried out only upon express order. Where corrosion protection is ordered, at least the preparation grade, coating system, color shade, dry film thickness, corrosivity category, edge machining and the surfaces not to be coated must be specified. Transport preservation is carried out only by agreement.
§ 7 Inspection and Acceptance
7.1 The type, scope and frequency of the in-house routine inspections are governed by the internal inspection planning, the contractual requirements and the respective manufacturing risk (quality management pursuant to DIN EN ISO 9001). A complete inspection of all parts or all dimensions, as well as a documented inspection report, are only owed if this is expressly agreed.
7.2 Non-destructive testing of the surface – visual testing (VT), magnetic particle testing (MT) and penetrant testing (PT) – is performed by in-house personnel qualified to level 2 pursuant to DIN EN ISO 9712, insofar as it is expressly commissioned.
7.3 Volumetric testing (radiographic testing RT, ultrasonic testing UT) is, insofar as commissioned, provided by qualified partners.
7.4 A formal acceptance or factory acceptance (for example with an inspection protocol or with the participation of the customer) takes place only if it is agreed; in all other respects, GTC § 8.4 applies. Inspections by the customer at the works are possible after timely scheduling.
7.5 Where non-destructive testing is ordered, the test method, test scope, test areas, test standards to be applied, acceptance or evaluation criteria and the extent of documentation must be specified at the time of order placement. In the absence of such specifications, Bock owes no non-destructive testing beyond the extent required by mandatory regulations or by the expressly agreed execution class.
§ 8 Certificates and Inspection Documents
8.1 Works and inspection certificates pursuant to DIN EN 10204 (2.1, 2.2, 3.1) as well as welding and inspection protocols are only prepared and supplied if their type and scope are expressly ordered at the time of order placement (cf. GTC § 8.7).
8.2 The documentation and inspection effort required for the respective certificate must be agreed separately and, unless otherwise regulated, remunerated.
§ 9 Pressure-Retaining Components
9.1 For the welding manufacture of pressurized components, Bock holds a manufacturer qualification pursuant to AD 2000-Merkblatt HP 0 (confirmed by GSI – Gesellschaft für Schweißtechnik International mbH / SLV). According to the respectively valid certificate, the scope is limited to unfired pressure vessels without heat treatment, the welding process 135 as well as the material groups 1.1, 1.2 and 8.1; the scope of the respectively valid certificate is authoritative.
9.2 For pressure-retaining components, Bock acts exclusively as manufacturer within the aforementioned certificate scope. The remaining requirements of the Pressure Equipment Directive 2014/68/EU – in particular design, conformity assessment, CE marking and technical documentation – are not the subject of this qualification and are assumed by Bock only if this is expressly agreed. The customer must provide the information required for design and inspection – in particular operating pressure, medium, temperature and the applicable code – in a timely and complete manner. Mandatory statutory manufacturer obligations and responsibilities remain unaffected.
§ 10 Marking, Packaging and Shipment
10.1 Marking of the parts (e.g. impact stamping, inscription, label) is carried out by agreement or according to drawing specifications. Without a customer specification, marking is carried out only insofar as Bock deems it necessary for production control, allocation or traceability; in doing so, Bock selects a suitable, material-friendly type of marking.
10.2 Packaging is carried out in a commercially customary and transport-appropriate manner. Special packaging (e.g. seaworthy packaging, long-term preservation, customer-specific load carriers) is carried out only upon express order and charged separately.
10.3 The passing of risk and the shipping modalities are governed by the GTC (§ 5). If a specific Incoterms® 2020 clause stating the named place is agreed in the individual contract, it takes precedence over the provisions of GTC § 5 (e.g. “FCA Bock Maschinenbau GmbH, Maierhofstraße 38, 73547 Lorch, Incoterms® 2020”). The mere indication “Incoterms 2020” without a specific clause and named place is not sufficient.
§ 11 Quality Management, Applicability and Amendments
11.1 Bock maintains a certified quality management system pursuant to DIN EN ISO 9001 in the edition indicated in the respectively valid certificate.
11.2 These TLB apply to the entire business relationship. For each contract, the version of the TLB that was effectively incorporated before or at the time of conclusion of the contract applies; a new version applies to future contracts only after corresponding incorporation or express agreement.
11.3 Amendments and supplements to these TLB require text form. In all other respects, the concluding provisions of the GTC apply accordingly; should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
11.4 In the event of discrepancies between a translation and the German version of these TLB, the German version is authoritative.
